Court asks CBI, ED, Raja and others to respond on appeal against acquittal

The Delhi High Court on Thursday asked CBI, ED, former Telecom Minister A Raja and others to present their stand on appeals challenging the acquittal of accused persons and companies in the 2G spectrum allocation case. Justice Dinesh Kumar Sharma said the parties would file brief written submissions not exceeding five pages. The counsel for the Central Bureau of Investigation (CBI) urged the court to list the matter at the earliest when he would argue the aspect of leave to appeal. On this, the judge fixed the date of hearing in the case on May 22 and 23. CBI’s counsel said, ‘The matter requires urgent hearing. Fix any time in the day for day-to-day hearing in the matter. Although the CBI had earlier completed its arguments on the issue of leave to appeal, it will have to argue the matter afresh due to the change of judge. Leave to appeal is a formal permission granted by a court to a party to challenge a decision in a higher court. Earlier, the matter was being heard on a day-to-day basis by Justice Brijesh Sethi, who retired on November 30, and on November 23, due to paucity of time, he removed the hearing of the matter from his side. Before leaving office, Justice Sethi had decided various petitions and applications filed by individuals and companies acquitted in three cases arising out of the 2G scam probe registered by the CBI and the ED. After completing arguments in the CBI’s main case, the high court will hear the Enforcement Directorate’s (ED) money laundering case in which all the accused were acquitted by the special court. A special court on December 21, 2017 acquitted Raja, DMK MP Kanimozhi and others in CBI and ED cases related to the scam. Besides Raja and Kanimozhi, the special court also named former Telecom Secretary Siddharth Behura, Raja’s former private secretary R.K. Chandolia, Unitech Ltd Managing Director Sanjay Chandra and three top Reliance Anil Dhirubhai Ambani Group (RADAJ) executives Gautam Doshi, Surendra Pipara and Hari Nair were acquitted in the case registered by the CBI. Swan Telecom promoters Shahid Balwa and Vinod Goenka and directors of ‘Kusegaon Fruits and Vegetables Pvt Ltd’ Asif Balwa and Rajeev Agarwal were also acquitted. The special court had also acquitted Swan Telecom (Pvt) Ltd., Unitech Wireless (Tamil Nadu) Ltd., Reliance Telecom Ltd., filmmaker Karim Morani and Sharad Kumar, director of Kalaignar TV, in the CBI case. The same day, the special court also acquitted 19 accused in the ED case, including Raja, Kanimozhi, DMK supremo M. Karunanidhi’s wife Dayalu Ammal, Vinod Goenka, Asif Balwa, Karim Morani, P. Amritham and Sharad Kumar. The ED had moved the High Court on March 19, 2018, challenging the decision of the special court.
