Court proceedings & JSC duties are essential – BASL

The Bar Association of Sri Lanka has called for steps to be taken to ensure that court proceedings, and duties of the Judicial Service Commission continue to function as an essential service.

President of the Bar Association President’s Counsel Saliya Peiris and Secretary Isuru Balapatabendige in a letter to the Chief Justice, and the Judicial Service Commission raised concerns over the decision by the Cabinet of Ministers to declare Friday a non-working day for all institutions except essential state services.

However, the Bar Association said court proceedings have not been included in the list of essential services.

The letter states that amidst the coronavirus pandemic, the judicial service was declared an essential service.

The Bar Association added that a number of government related cases are heard on Fridays adding that if the hearings are delayed, it will result in the public and many legal professionals facing difficulties.

The Bar Association said court proceedings during the COVID-19 pandemic were significantly delayed adding that such a situation should not arise again.

Therefore, the Bar Association requested the Chief Justice and the Judicial Service Commission to take necessary steps to ensure that court proceedings continue on Fridays.
