The U.S. Equal Employment Opportunity Commission (EEOC) has initiated legal action against a Coca-Cola bottler, alleging sex discrimination. The lawsuit claims that Coca-Cola Beverages Northeast excluded male employees from a networking event, which was exclusively for women. This event took place over two days in September 2024 at the Mohegan Sun casino resort in Connecticut.

The EEOC's lawsuit, filed in New Hampshire district court, accuses the company of violating Title VII of the Civil Rights Act of 1964. The agency has been actively challenging diversity programs since changes were made under President Donald Trump's administration.
EEOC's Stance on Discrimination
Acting EEOC general counsel Catherine L. Eschbach stated, "Excluding men from an employer-sponsored event is a Title VII violation that the EEOC will act to remedy through litigation when necessary." The agency is pursuing monetary compensation for affected male employees who experienced financial and emotional harm due to their exclusion.
The lawsuit follows the EEOC's recent announcement of an investigation into Nike's diversity policies, which allegedly discriminated against white employees. These actions reflect the agency's focus on scrutinising diversity initiatives that may inadvertently lead to discrimination.
Coca-Cola Northeast's Response
Coca-Cola Beverages Northeast expressed disappointment over the EEOC's decision to file the lawsuit without conducting a comprehensive investigation. In a statement to The Associated Press, the company said it looks forward to presenting its case in court and expects to be vindicated.
On LinkedIn, Coca-Cola Northeast highlighted its first in-person Women's Forum attended by 250 female associates. The event featured discussions on navigating male-dominated industries and balancing work and personal life. The company covered expenses for attendees, including lodging and meals, while also paying their salaries during the event.
Impact on Diversity Programs
The EEOC's lawsuit underscores potential pitfalls in diversity programs if not carefully structured. While the agency's fact sheet on DEI-related discrimination does not label any specific practice as illegal, it warns that certain approaches could lead to discrimination.
The EEOC pursued legal action after failing to reach a conciliation agreement with Coca-Cola Beverages Northeast. This independent bottler serves regions including New England and upstate New York.
The outcome of this case could influence how companies design diversity initiatives to ensure compliance with civil rights laws while promoting inclusivity.
